About WakeFail
WakeFail is an early-rise alarm app with a built-in community. In the morning you take on alarm-clock challenges, share what you got up to that day, and join other early risers through public posts, comments, and direct messages. WakeFail is developed and operated by BeeBaby HK Limited ("we," "us," "our").
These Terms — together with our Privacy Policy and Community Guidelines — set out the basics for using WakeFail. Other agreements (like our subscription, auto-renewal, and content publishing terms) apply when you use those specific features, and we'll show them to you at that point.

Acceptance
In short
Using WakeFail means you accept these Terms. If you don't agree, please uninstall the app.
By creating an account or otherwise using WakeFail, you agree to these Terms and to our Community Guidelines. If you don't agree to any part of these Terms, please don't create an account or use the app.
WakeFail is for adults 18 and older. If you're under 18, you can't use the app — please stop registration and uninstall it.

Eligibility
In short
You must be 18 or older and register with truthful information.
To use WakeFail, you need to meet all of the following:
- Age: at least 18 and able to enter into a binding contract under the law that applies to you.
- Truthful info: give us accurate date of birth, gender, and contact details when you sign up.
- Local law: your use of the app must be legal where you live.
- Not previously banned: we haven't already terminated your access for breaking these Terms.
Important
We have zero tolerance for minors on WakeFail. If we identify an account as belonging to a minor, we'll terminate it and delete the associated data as described in our Privacy Policy.

Your Account
In short
Your account is yours alone. You're responsible for activity on it, and accounts cannot be transferred or shared.
Account security
- Keep your sign-in details (phone number, verification codes, and the like) to yourself — don't let anyone else into your account.
- You're responsible for everything that happens on your account, including what people you let in end up doing.
- If you think your account has been compromised or you're seeing activity you don't recognize, get in touch with us right away.
Account restrictions
- Don't sell, lend, transfer, or share your account with anyone else.
- Don't buy, sell, or otherwise trade access to anyone else's account.
- Don't use scripts, bots, or scrapers to access WakeFail.
Deleting your account
You can delete your account anytime under "Settings → Account → Delete Account." Once you request deletion, the account is deactivated immediately. You can bring it back by logging in within 30 days; after that, the account and everything tied to it are permanently deleted and can't be recovered. Paid memberships and virtual goods aren't refundable.

Your Content
In short
Your content stays yours. You give us a limited license to display it on WakeFail, and we won't use it for outside commercial purposes.
Ownership
The photos, videos, text, and other content you post on WakeFail ("your content") stay yours. We don't claim ownership of anything you create.
The license you give us
So we can actually run and improve WakeFail, you give us a worldwide, royalty-free, non-exclusive license to store, display, distribute, and recommend your content inside the app, and to make thumbnails and previews. The license only covers what we need to deliver the service to you and other users — nothing more.
This license ends when you delete the content (it may take a short while for cached copies on our servers to clear). We won't use your content in ads off WakeFail, and we won't hand your personal content to third parties for their commercial use.
Content moderation
We use a mix of automated tools and human review to spot content that may break these Terms, our Community Guidelines, or applicable law. We can take down content that crosses those lines, and we may limit how widely it's shown while it's being reviewed. Where it's reasonable to do so, we'll tell you what happened and how you can appeal.
Your promises about what you post
When you post content, you're telling us that you own it or have permission to use it; that it doesn't infringe anyone else's IP, likeness, or privacy; and that it follows these Terms and our Community Guidelines.

Prohibited Conduct
In short
WakeFail isn't the place for harassment, fraud, or harmful content. Doing any of the things below can get your account actioned.
To keep WakeFail safe and welcoming, the following are off-limits:
Impersonation and fraud
- Pretending to be a real person, public figure, brand, or WakeFail employee.
- Using someone else's photo as your profile picture, or posting anything designed to make people think you're somebody you're not.
- Lying about your age — especially claiming to be 18+ when you aren't.
- Asking other users for money, gift cards, or banking details, in any form.
Harassment and harmful behavior
- Harassing, threatening, intimidating, or stalking anyone.
- Continuing to message someone after they've said no or asked you to stop.
- Hate speech aimed at people because of race, ethnicity, gender, religion, sexual orientation, disability, or similar.
- Encouraging or egging on self-harm, violence, or other dangerous behavior.
Prohibited content
- Posting pornographic, nude, or sexually suggestive content.
- Posting anything that sexually exploits or endangers minors (including CSAM, in any form).
- Posting content that glorifies violence, gore, terrorism, or extremism.
- Recording or sharing private videos or photos of other people without their consent.
- Posting content promoting illegal drugs, weapon sales, human trafficking, or anything else outlawed where you live.
Technical abuse
- Accessing the app without authorization, cracking it, reverse-engineering it, or tampering with how it works.
- Launching DDoS or any other kind of network attack against us.
- Using automated tools to bulk-like, bulk-comment, or bulk-message.
- Getting around (or trying to get around) our security or access controls.

Community Safety
In short
We give you tools to control your experience. When something feels off, use them — block, mute, or report.
WakeFail is a place to share real moments. But we can't verify everything people say here, and we can't vouch for what anyone does off the platform. So when you're talking to other users, keep your guard up.
A few habits that help keep the community safe:
- Protect your personal info: don't share your precise location, financial info, government IDs, or other sensitive details in chats — especially with people you've just met.
- Spot common scams: if someone asks for money, gift cards, crypto, or banking info, that's a red flag. Report them and stop replying.
- Use our tools: if a user or piece of content breaks these Terms or our Community Guidelines, block, mute, or report them.
- Trust your gut: if a conversation feels off, you can walk away anytime.
- Emergencies: if you or someone else is in immediate danger, call your local emergency services first.
Keeping WakeFail safe is a team effort — every report helps us respond faster.

Third-Party Services
In short
We rely on Apple, Google, and others for payments and other behind-the-scenes pieces. Those services run on their own terms, and we don't control how they behave.
WakeFail relies on the following third-party services:
- Apple App Store / Google Play: handle in-app purchases and subscriptions under Apple's and Google's own terms and privacy policies.
- Cloud storage: hosts the photos and videos you upload.
- Push notifications: deliver alarm reminders, match alerts, and system messages.
- Geolocation: powers nearby-user recommendations in the discovery feature.
- On-device AI (Google ML Kit): runs locally on your phone to check whether a face is in the frame during selfie-style alarm challenges and video authenticity recording. Nothing is sent to our servers.
- Video authenticity verification (Amazon Rekognition): provided by Amazon Web Services. Only runs when you actively start video authenticity verification — to compare your recorded video against your current profile photo and catch impersonation. Our Privacy Policy spells out exactly what's processed, where it's stored, and how long we keep it.
- Product analytics (Mixpanel): helps us understand how features are used so we can improve them. It records in-app usage events — not advertising identifiers — and we don't use it for advertising or cross-app tracking. See our Privacy Policy for the details.
We aren't responsible for what third-party services do, what's in them, or whether they're up. To the fullest extent allowed by law, we aren't liable for losses caused by changes or outages in those services.

Termination
In short
Breaking these Terms can get your account terminated. You can also delete your account anytime.
When we may step in
We may suspend, restrict, or terminate accounts that break these Terms, applicable law, or our Community Guidelines — including in situations like:
- Breaking these Terms or any of the supplemental agreements.
- Behavior that puts other users at risk.
- Long inactivity (no sign-in for more than 12 months).
- When applicable law or a binding legal order requires it.
Where it's reasonable, we'll give you a heads-up before we act, tell you why, and let you know how to appeal. When safety, security, or the law is on the line (e.g., illegal content or an imminent risk of harm), we may act first and notify you after.
What happens after termination
- You lose access to the account and the content you posted from it.
- The content license you gave us ends along with it (cached copies on our servers may take a short while to clear).
- If your account is terminated for a violation, paid fees generally aren't refundable — except where the law or the relevant app store says they have to be.
- Termination doesn't undo rights or obligations either side already had before it happened.
If you think we got it wrong, you can appeal by email. We aim to review and respond within 5 business days.

Disclaimer
Heads up
WakeFail is provided "AS IS" and "AS AVAILABLE." We disclaim all express and implied warranties — including merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent allowed by law.
To the fullest extent allowed by law, we don't promise that the app will run without interruption or errors, that you'll get any particular result from using it, or that anything other users say here is true.
To the fullest extent allowed by law, we aren't responsible for: disputes or losses between users; what other users do offline; outages or failures at third-party services; or service interruptions caused by things outside our reasonable control (think natural disasters, network failures, or regulatory changes).
About the alarm feature
Important
WakeFail is a social challenge app, not a system alarm. Our in-app alarm challenge can't and isn't meant to replace your phone's built-in alarm clock.
iOS and Android put real limits on background apps — battery, notifications, auto-start, Do Not Disturb, Focus mode, low-power mode, background refresh, and camera/mic/notification permissions, among others. Behavior also depends on your device model, OS version, manufacturer's customizations, the permissions you've granted, and any third-party app managers you've installed. Because of all that, our alarm challenge may be delayed, silent, fail to show up, fail to wake the screen, fail to play a sound, or fail to fire at all.
To the fullest extent allowed by law, we aren't responsible for anything that follows if the in-app alarm doesn't fire as expected — being late, missing work or class, missing flights, trains, exams, or meetings, missing medication, missing appointments, financial loss, disciplinary action, or any other direct or indirect harm. For anything that really matters, please set your phone's built-in alarm (or another reliable reminder) as your main safeguard.

Indemnification
In short
If something you do gets us in trouble, you cover the costs.
To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless WakeFail and its affiliates, directors, employees, and partners from any third-party claim, loss, fine, or reasonable attorneys' fees arising out of: breaking these Terms, misusing the app, the content you post, or infringing someone else's rights.

Dispute Resolution
In short
If something goes wrong, come to us first. If we can't work it out, disputes go to the courts of Hong Kong SAR.
Talk to us first
If you've got a problem, please reach out to support before going further — most things get sorted without a formal process, and we'd like the chance to make it right.
Governing law and venue
If we can't resolve a dispute that way, these Terms are governed by the laws of the Hong Kong Special Administrative Region, and any disputes will be brought in the competent courts of the Hong Kong Special Administrative Region.
If a provision doesn't hold up
If any part of these Terms turns out to be invalid or unenforceable, the rest still applies.

Changes to these Terms
In short
We'll let you know ahead of time when something material changes. If you keep using WakeFail after that, you're accepting the new version.
We may update these Terms from time to time. For material changes — like adding new user obligations or trimming rights you have today — we'll give you at least 14 days notice through an in-app prompt or another reasonable channel, and ask you to confirm before they take effect.
For smaller clarifying updates, we'll bump the "Last Updated" date at the top and post a notice in the app. If you keep using WakeFail after that notice period, you're accepting the updated Terms.
If you don't agree with an update, please stop using WakeFail and delete your account before the new Terms kick in.

Subscriptions and Auto-Renewal
Mandatory disclosure — please read before you subscribe
WakeFail offers auto-renewing subscriptions sold through the Apple App Store and Google Play. By initiating a subscription, you acknowledge that you have read and agree to this Section, the VIP Membership Agreement, and the Auto-Renewal Service Agreement.
14.1 Subscription Offering
- Title: WakeFail VIP Membership.
- Length of each subscription period: 1 month, 3 months, or 12 months, as selected by you at checkout.
- Price: the price of each plan, inclusive of applicable taxes where required by law, is displayed on the in-app purchase screen at the time of purchase. Prices may vary by storefront, promotional offer, and currency.
- Benefits: the features and entitlements described on the in-app purchase screen and in the VIP Membership Agreement, which apply during each paid period.
14.2 Apple App Store (iOS)
- Payment will be charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews for the same subscription period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the price disclosed at purchase (or, if the price has changed, at the new price that you have separately re-consented to through Apple).
- Subscriptions may be managed by you, and auto-renewal may be turned off, by going to Settings › [Your Apple ID] › Subscriptions after purchase. You cannot cancel the subscription from within the WakeFail app.
- Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription to the same publication.
14.3 Google Play (Android)
- Payment will be charged to your Google Play account at confirmation of purchase.
- The subscription automatically renews at the end of each billing period at the then-current price unless you cancel it at least 24 hours before the end of the current period.
- If a free trial or introductory price is offered, the duration and the price applicable after the introductory period will be disclosed on the purchase screen; to avoid being charged, you must cancel before the introductory period ends.
- You may manage and cancel your subscription at Google Play › Payments & subscriptions › Subscriptions. You cannot cancel the subscription from within the WakeFail app.
14.4 Refunds
All purchases are processed by Apple or Google. Refund requests are governed by the policies of, and must be submitted to, the applicable platform. We have no ability to grant refunds on Apple's or Google's behalf. The limited circumstances in which we will issue an equivalent credit or arrange a refund (for example, duplicate charges caused by our system or an extended service outage attributable to us) are set forth in the Auto-Renewal Service Agreement.

Apple App Store Additional Terms
When this Section applies
This Section applies only when you have obtained WakeFail through the Apple App Store. To the extent the terms of this Section conflict with any other provision of these Terms, this Section will control solely with respect to your use of WakeFail obtained from the Apple App Store.
15.1 Acknowledgement
You and BeeBaby HK Limited acknowledge that these Terms are concluded between you and BeeBaby HK Limited only, and not with Apple Inc. ("Apple"), and that BeeBaby HK Limited, not Apple, is solely responsible for WakeFail and the content thereof. To the extent these Terms provide for usage rules for WakeFail that are less restrictive than, or in conflict with, the Usage Rules set forth in the Apple Media Services Terms and Conditions, the less restrictive or conflicting Apple term will take precedence solely with respect to that conflict.
15.2 Scope of License
The license granted to you for WakeFail is a limited, non-transferable license to use WakeFail on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that WakeFail may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
15.3 Maintenance and Support
BeeBaby HK Limited is solely responsible for providing any maintenance and support services with respect to WakeFail, as specified in these Terms or as required under applicable law. You and BeeBaby HK Limited acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to WakeFail.
15.4 Warranty
BeeBaby HK Limited is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of WakeFail to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of WakeFail (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to WakeFail, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be BeeBaby HK Limited's sole responsibility.
15.5 Product Claims
You and BeeBaby HK Limited acknowledge that BeeBaby HK Limited, not Apple, is responsible for addressing any claims by you or any third party relating to WakeFail or your possession and/or use of WakeFail, including, but not limited to: (i) product liability claims; (ii) any claim that WakeFail fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with WakeFail's use of the HealthKit and HomeKit frameworks (if applicable).
15.6 Intellectual Property Rights
You and BeeBaby HK Limited acknowledge that, in the event of any third-party claim that WakeFail or your possession and use of WakeFail infringes that third party's intellectual property rights, BeeBaby HK Limited, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
15.7 Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
15.8 Developer Name and Address
Any questions, complaints, or claims with respect to WakeFail should be directed to BeeBaby HK Limited at the registered office and support email set forth in the footer of this page.
15.9 Third Party Beneficiary
You and BeeBaby HK Limited acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
